9bot Terms of Use

These Terms of Use govern access to and use of 9bot, a global WhatsApp automation service for communities, group administrators, content portals, businesses and operations that want to automate moderation, commands, RSS, replies and recurring routines.

By creating an account, starting a trial, purchasing a plan, connecting a number, using the dashboard or using any 9bot feature, you accept these Terms and the additional policies published by the service. 9bot operates under the user's configuration and direction and does not perform autonomous actions outside the scope defined by the responsible administrator.

9bot is an independent solution. Unless expressly stated otherwise, the service is not affiliated with, sponsored by or operated by WhatsApp LLC, Meta Platforms or companies in the same group.

Scope

The service is offered globally and may be used by users located in different countries, subject to applicable law and the technical and operational limitations of each integration.

1. Acceptance, eligibility and account

1.1. You represent that you have legal capacity to contract the service or authority to bind it on behalf of a company, team, brand, community or organization.

1.2. You are responsible for keeping registration data accurate, restricting third-party access to the dashboard and protecting credentials, pairing codes, QR codes, keys and other authentication methods.

1.3. If you identify unauthorized use, a compromised account or a security incident, you must notify 9bot without undue delay through the official channels.

2. Service description

2.1. Depending on the contracted plan and product evolution, 9bot may provide features such as automatic moderation, filters, interactive commands, configurable replies, RSS feed integration, scheduled message sending, reports, metrics and other routines for WhatsApp.

2.2. The service is provided subject to availability and may undergo technical changes, functional updates, temporary limitations, regional restrictions or dependencies imposed by partners and third-party platforms.

3. Limited license to use

3.1. 9bot grants you a limited, revocable, non-exclusive, non-sublicensable and non-transferable license to use the platform in accordance with these Terms and the contracted plan.

3.2. No intellectual property rights are transferred to you by reason of using the service. The 9bot brand, dashboard, flows, documentation, software, visual identity and other components remain owned by 9bot or its licensors.

Plans, billing and cancellation

By starting a free trial, subscribing to a plan or making a payment to 9bot, you accept the commercial rules set out below.

1. Plans and trials. 9bot may offer free trials, promotional access and recurring paid plans. The included features, number of groups, operational limits, prices and billing cycles will be those published on the commercial page, payment page or applicable proposal.

2. Recurring billing. When you purchase a paid plan, you authorize recurring charges according to the selected billing frequency. 9bot may use third-party payment processors, including Stripe, according to the option available at the time of contracting.

3. Processing by Stripe. When payment is made through Stripe, transaction processing, fraud analysis, payment capture, recurring billing management, chargeback handling and, where applicable, refunds may be carried out by that provider in accordance with its own terms, policies and operational requirements. By completing the purchase, you authorize the sharing of data strictly necessary for billing, invoicing, fraud prevention and compliance with legal obligations related to payment.

4. Taxes, fees and exchange variation. The amounts displayed may not include taxes, IOF, bank charges, card fees, conversion costs, local taxes or similar expenses. Where applicable, such amounts may be added or passed on to you.

5. Automatic renewal. Unless expressly stated otherwise, subscriptions renew automatically at the end of each cycle until the user requests cancellation or 9bot cancels it in accordance with the terms of this document.

6. Cancellation. You may request cancellation through the means made available by 9bot. Cancellation prevents future charges, but does not automatically generate a proportional refund of amounts already paid, except when required by law or by a specific commercial policy.

7. Non-payment. Failure to pay may result in feature suspension, operational limitation, blocking of dashboard access, disconnection of integrations or termination of the service.

8. Commercial changes. 9bot may review prices, plan formats, packages, limits or benefits for technical, commercial, operational, legal or strategic reasons. When a change materially affects ongoing recurring contracts, reasonable prior notice will be provided through the available channels.

Use, data and integrations

You are responsible for the context in which 9bot is used, the configured content and the legal compliance of the automations you choose to operate.

1. Permitted use. The service must be used only for lawful purposes compatible with applicable law, WhatsApp rules and the policies of third-party services integrated into the automation flow.

2. Prohibited use. It is prohibited to use 9bot for spam, fraud, harassment, unlawful misinformation, phishing, unsolicited mass messaging, malware distribution, infringement of third-party rights, improper data collection, attempts to bypass technical limits, unauthorized scraping or any abusive activity.

3. Responsibility for content. Links, replies, commands, feeds, moderation rules, scheduled messages and any materials operated by 9bot are the responsibility of the user who configured or authorized them. You represent that you have the necessary permissions and legal bases for such uses.

4. Third-party services. 9bot operation may depend on external platforms, including WhatsApp, payment gateways, hosting services, dashboards, public feeds and APIs. Such third parties may change policies, interfaces, prices or availability at any time, and 9bot may adapt, limit or discontinue the affected features.

5. Data processing. 9bot adopts a data minimization approach and uses only the data necessary to provide the service, security, technical logs, support, abuse prevention and compliance with legal obligations. The user must assess whether they have an appropriate legal basis to process third-party personal data in the context of the automations they configure.

6. Bot operational limits. 9bot executes actions directed by the user's configuration. The service should not be interpreted as an unrestricted autonomous agent. According to the product's public policy, 9bot must not be used for general web scraping, collection and sale of personal data, credential stuffing, network attacks or unauthorized access to resources and APIs.

7. Operational security. You must control which administrators have access to the connected number, the dashboard and the automated rules. 9bot may keep operational records necessary for audit, integrity, diagnosis and incident response.

Support, availability and final provisions

The following clauses cover service availability, account suspension, limitations of liability and official communications.

1. Availability. 9bot uses commercially reasonable efforts to keep the platform available, but does not guarantee uninterrupted operation, operation free of failures or immunity from external blocks, network instability, third-party unavailability, policy changes, incompatibilities or events outside its reasonable control.

2. Support. Support will be provided according to the channels and service levels disclosed by 9bot. Use of the service requires the user's cooperation with minimum information for diagnosis, including data about the environment, the contracted plan and the observed behavior.

3. Suspension and termination. 9bot may suspend or terminate access to the service, with or without prior notice depending on the severity of the case, in situations involving breach of these Terms, non-payment, legal order, technical risk, abusive use, reputational risk, fraud, security compromise or operational infeasibility of the service.

4. Disclaimers and limitation of liability. To the fullest extent permitted by applicable law, the service is provided as is and as available. 9bot is not liable for indirect damages, loss of revenue, lost profits, loss of data, interruptions caused by third parties, external account blocks, incorrect user configurations or content operated by the user.

5. Changes to these Terms. 9bot may update these Terms for legal, technical, commercial or operational reasons. The most recent version will prevail from its publication or from the date stated in the document itself. Continued use of the service after the changes take effect will be interpreted as acceptance of the revised version.

6. Governing law and dispute resolution. These Terms will be interpreted in accordance with the law applicable to the contractual relationship, without prejudice to mandatory rules on consumer protection, data protection and other mandatory provisions applicable to the user in their jurisdiction.
