Work WhatsApp groups and overtime in Brazil: what labor law says
A guide for managers and admins of company groups with employees in Brazil. It summarizes Brazilian law and does not replace advice from a labor lawyer.
Direct answer: In Brazil, being in the company WhatsApp group does not create overtime by itself. Since Law 12,551/2011, the CLT treats command by telematic means the same as direct command, and TST Precedent 428 says an employee is on call (sobreaviso) when, controlled remotely, they stay on standby waiting to be called during rest time. If the employee performs tasks through the group outside working hours, that time can be claimed as overtime. On-call hours are paid at 1/3 of the normal wage under CLT article 244.
In short:
- Being in the group alone is not on-call time.
- Remote standby waiting for calls is on-call time, paid at 1/3 of the hourly wage.
- Actual work through the group after hours can be overtime, with a premium of at least 50%.
What Brazilian law says
| Rule | What it sets |
|---|---|
| CLT, art. 6, sole paragraph | Telematic and computerized means of command, control and supervision are equivalent to personal and direct means for the purpose of subordination. Wording from Law 12,551/2011. |
| TST Precedent 428 | Using telematic tools supplied by the employer does not, by itself, mean on-call time. An employee who, remotely and under employer control, stays on standby waiting to be called during rest is on call. |
| CLT, art. 244, § 2 | On-call hours count at 1/3 of the normal wage, with shifts of at most 24 hours. |
| Federal Constitution, art. 7, XVI | Overtime is paid with a premium of at least 50% over the normal hour. |
Each case depends on the evidence, such as how often messages arrive, whether a reply is required and what happens if the employee does not reply.

Common situations in company groups
| Situation | Likely treatment |
|---|---|
| General notice read whenever the employee wants, with no reply required | As a rule, neither overtime nor on-call time |
| Standby roster with a duty to answer calls through the group | May be on-call time (Precedent 428, II) |
| Task carried out through the group after hours | May be overtime, if the work is proven |
| Demands for immediate replies at night and on weekends | Raises the risk of on-call time or overtime being recognized |

Good practice for company groups
- Publish a written policy on using the group outside working hours.
- Separate the announcement group from the operations group and define who can post in each.
- Schedule notices for working hours instead of sending them at night.
- If there is a standby roster, formalize it and pay on-call time.
- Keep a record of the group rules and rosters.
